Question: After five sessions of multiemployer bargaining, the Carpenters' Union and the Lake Charles District of the Associated General Contractors of Louisiana reached a new agreement. However, the printed contract inadvertently omitted a "weather clause," which was to state that an employee who reported for work but was sent home because of inclement weather would get four hours' pay, and an employee sent home because of weather after having started work would get paid only for hours actually worked, but not less than two hours. When the omission was discovered, the contract was already ratified and signed. The union refused to add the clause. The company then asked to reopen bargaining over the wage and reporting clauses that were affected by the omission. The union refused. Who, if anyone, has committed an unfair labor practice?
