Individuals suffering from mental health and substance use disorders with involvement in the criminal justice system can cause great economic burdens to national, state, and local agencies as well as the individual. Diverting individuals with these conditions away from jails and prisons and toward appropriate and culturally competent community-based services supports the need to remove unnecessary involvement in the criminal justice system.

Case Scenario:

Holly, a family drug court case manager in Wayne County, Michigan is working with Madeline, a 26-year-old, Haitian-American female with three children, ages, 3 months old, 2 years old, and 4 years old. Madeline is on probation due to her record of multiple arrests (ranging from shoplifting to disorderly conduct to a drug possession charge), and is an active user of cocaine. Madeline also has a history of domestic violence (as a victim) with her children's father Sam, who is currently incarcerated in jail for a felony domestic violence for one year. The Department of Children and Family Services has petitioned the court to remove the children from Madeline's care due to her continued drug use, her ability to care for her children. Madeline recently was evicted from her apartment since her paramour's incarceration. Madeline is challenged with locating employment due to her criminal history and language barriers as she primarily speaks French but can decipher and speak some English. Madeline is scheduled to start an 18-month cosmetology program, however, with all her legal and family challenges ahead of her she is uncertain if she will start school. She does not have transportation and is losing motivation to have a better life for her and children.

Holly is scheduled to meet with the presiding judge, a representative from the Department of Children and Family Services, and Probation Officer.
