1. In response to the acquittal of O.J. Simpson, Professor Paul Butler advocated for racially based jury nullification. He stated, "It is the moral responsibility of black jurors to emancipate some guilty black outlaws" (as cited in Delgado & Stefancic, 2000, p. 195). Professor Randall Kennedy raised objections to Professor Butler's views on a number of grounds, including that playing the race card in a criminal trial is "virtually always morally and legally wrong" (as cited in Kennedy, 1997, p. 256). Analyzing the argument on both sides, who do you think makes the more compelling case? Do you believe that juries should engage in jury nullification? Why or why not?
2. A new head of corrections at a county facility has determined that too many of her staff have gotten into their leadership positions (managers and supervisors) through longevity and by default. Because she is unable to move them out of their positions due to bureaucratic rules, she has decided to implement a leadership development program that encompasses both existing leaders as well as individual contributors who hope to one day become leaders in the organization.
The leadership development program will include OJT, in-house workshops, and "credit" for taking approved leadership classes offered by an online university. In addition, leadership skills will become part of each manager's and supervisor's evaluation. This represents a big change for the organization.
Analyze and discuss the potential sources of personal and organizational resistance that the head of the facility should take into consideration and recommend appropriate solutions for dealing with each issue you identify.
