Six months ago, you were named as the new manager of [insert your preferred sport organization here]! Throughout your short time on the job, you have been evaluating the current organization, including its facilities, operations, and policies. You have found that while the organization is in good standing, generally speaking, there are some areas of improvement.
You have routinely kept your boss, the organization’s president, informed of these areas of improvement through business memos. Your boss, who is very busy keeping the organization running smoothly, greatly appreciates your ability to communicate your ideas thoroughly and succinctly in these memos—fully elaborating ideas in a formal and concise manner.
You have recently read a Sport Illustrated article* describing a lawsuit in which a Major League Baseball player is suing an opposing club for negligence after he was injured at the club’s stadium. In the suit, the player alleges that the facility created an unreasonable risk of injury. It reminded you of an old YouTube video* of a college football player who was also injured due to an improperly maintained facility. As the manager who oversees your organization’s primary sport facilities, you are concerned that your organization may be susceptible to such lawsuits.
Write a memo to your boss, the organization’s president, about your concerns. The memo must include the following:
1) Discuss the legal aspects of negligence. This should include, at minimum, a definition of negligence, and elements of a cause of action.
2) Discuss the examples provided in the article and video. Specifically, address the actions of the MLB club, college football program, and others that left them exposed to liability for negligence.
3) Explain why this is a concern for your organization, including how the mistakes made by these organizations might translate to your organization.
4) Introduce a strategy to help your organization minimize its own risks associated with negligence lawsuits.
