Boston: Pearson Chapter 11 outlines the historical background, guidelines, and court cases associated with various Constitutional rights and limitations that prisoners are subject to while incarcerated. One of the most vague Constitutional Amendments is the interpretation of the 8th Amendment to prisons. Examine the 7 court cases in Table 11-1 of the textbook and discuss the criteria that the courts are using to conclude whether a condition and/or situation constitutes cruel and unusual punishment. Provide examples from any of the court cases listed. Now, examine the cases discussed in Table 11-2 on the 14th Amendment's Equal Protection Clause. How is the U.S. Supreme Court interpreting "Equal Protection" as it relates to incarcerated prisoners?
