Question - Favre suffered a concussion when he was kicked in the head while playing football. He could not remember anything that happened that day after he suffered the concussion. However, he singed a written contract just after he suffered the concussion in which he agreed to sell a rare sculpture to Brady for $10,000.00. The fair market value of the sculpture was $15,000.00. Brady paid the $10,000.00 to Favre when they signed the contract. A few days later, Favre lost the $10,000.00 playing poker in Las Vegas. He then realized that he did not want to sell the sculpture and, in any event $10,000.00 was not a good price. Therefore, Favre refused to deliver the sculpture to Brady, who then sued Favre for breach of contract. Discuss the best argument that could be made by either in this case.
