Question

Eugene Eu entered into negotiations with Apple Wan, a property agent, for a three-year rental agreement for a house in East Coast Road.

Eugene told Apple that the house he wished to rent must be in a quiet neighbourhood be free of any noisy construction activities. This was because his daughter, Emily Eu, was in law school and needed a quiet environment to pursue her studies. given that most of the university lectures are conducted cntine due to the Covid-1El pandemic.

Two weeks later, Apple chanced upon a nice house for rent located along Jalan Miranda, East Coast Road. Understanding Eugene's requirement that there be no noisy construction activities for at least three years in the neighbourhood, Apple checked with the relevant authorities about this. She was told that MRT construction work would begin in a year's time. Believing that by then Eugene would be too settled into the new house to care about the construction work. Apple took it upon herself to make false representations to Eugene in an effort to get the house rented to him and thereby eam her commission.

Apple then contacted Eugene and told him that she had found a house for him. After viewing the house, Eugene again stipulated his condition that there be no noisy construction work in the area for at least three years. Apple assured him that no such work was being planned by the authorities.

A year after signing the lease agreement and moving into the house, noisy MRT construction activities began in the area. Eugene called Apple to demand an explanation as to why his speci?c instructions were not observed. Apple calmly said she did check with the relevant authorities and did know that construction work would commence a year after he moved in but said that he himself should have checked before renting the house, and that if he did not bother to check, it was his problem. Enraged, Eugene now intends to rescind the contract.
