The enforcement of a contract without consideration is an exception to our earlier understanding of enforceable contracts. However the court recognizes some limited exceptions and will deem a contract enforceable despite a lack of valid consideration.

1. Discuss each of the four exceptions recognized by the courts, whereby past performance performance may be deemed sufficient consideration. Do you agree or disagree with the use of these exceptions? Why?

2. In Webb v. McGowin, 168 S. 196 (Ala. App. 1935) as referenced in the text, an employee suffered injuries rescuing their employer from a life-threatening worksite hazard. In the process the employee was injured. The employer promised to compensate the employee for the rescue. The employee prevailed under the moral obligation concept. Using the information you have (you don't have to read the full case), do you think the outcome was fair or not? Why?
