Assignment: State Vs Hudson Case Closing Statement Paper

Students should prepare a written closing argument for the case of State v. Hudson. This is a criminal case alleging murder and attempted armed robbery. You have been provided a packet of case materials. Because this is a criminal case, the burden of proof will be beyond a reasonable doubt. You will be assigned to either represent the Prosecution or the Defendant in this case.

The presentations will be on October 24 and should be between 5-7 minutes long. You may use an outline for your oral presentation, but you should not read your presentation. You will be evaluated on both the content and presentation value.

In preparing your closing arguments, refer to Chapter 8 of your text, your lecture notes, mock trial video training, and the example closing argument provided for State v. Merle Rausch. I will evaluate your closing arguments based upon the objectives and principles identified in these sources, focusing on the communication aspects. Papers should be 4 to 5 pages typed, double spaced, 12 point and are due on October 24. (both Prosecution and Defense).

Attempted Armed Robbery

The crime of attempted armed robbery requires proof of the following:

A. The defendant intended to take property of another person in the immediate presence of such person; and

B. The intended taking was against the other person's will; and

C. The defendant threatened to use force against any person with the intent to force surrender of the property or to prevent resistance to taking or keeping the property; and

D. The defendant or an accomplice, in the course of attempting to commit the robbery, was armed with a deadly weapon.

Felony Murder

The crime of first-degree felony murder requires proof that:

A. The defendant committed or attempted to commit armed robbery; and

B. In the course of and in furtherance of this crime or immediate flight from this crime, the defendant or another person caused the death of any person.
