Two hypothetical scenarios
Annabelle was dismissed from her job as a waitress at Hot Grill after she insisted to her boss Coby that she be paid extra for waitressing on weekends and to give her longer breaks. She believed that she had been underpaid for more than a year and that her breaks were too short. She calculated that she was owed more than $3,000 in backpay.
Annabelle knew Coby was active on dating websites. She asked her friend Georgia, who was very successful on dating websites, to create a fake profile to entice Coby to give her the money that was owed. Georgia created a fake profile and started flirting with Coby on-line. Coby became very interested. In the meantime, Annabelle sought out legal advice on her backpay. The lawyer told her that in fact Coby had paid her in accordance with law and that he did not owe her any money.
Despite this, after some weeks of on-line flirting, under instruction from Annabelle, Georgia told Coby that she had a sick puppy and urgently needed $3,000 to pay for vet bills. Coby did so, straight into Annabelle's account. There was no sick puppy.
Discuss Annabelle and Georgia's criminal liability.
Fox and Milo were on opposite teams at rugby. They had been playing a tough match and Fox was angry that Milo kept tackling him. Fox hit Milo in a head high tackle which gave Milo a mild concussion. Head high tackles are no longer allowed in rugby games, but they are quite common. The referee, Eliza, sent Fox off the field and came to check if Milo was okay. Milo was confused and groggy, he saw Eliza looming over him and thought Eliza was a player about to hit him, so he kicked Eliza in the shins. She had weak bones and her leg was broken.
Discuss the criminal liability of Fox and Milo.
