Torts and the Public Administrator
The world is becoming more litigious than ever, particularly in government and law. Frankly, there will always be individuals challenging government actions through lawsuits. One example of this is the tort-based lawsuit. A tort is a civil wrong which can be remedied through civil litigation, usually through the awarding of damages. Prior to the 1960s, the government was largely protected from tort-based lawsuits through "sovereign immunity." Since the 1960s, sovereign immunity has been rescinded through judicial decisions. Accordingly, the government has increasingly encountered tort-based lawsuits. As a result, a public administrator must be aware of the torts that he or she may encounter on the job.
Review Chapter 7, "Torts," in The Study of Law: A Critical Thinking Approach (4th ed.). Reflect on the torts a public administrator may encounter.
Think of two examples of torts a public administrator may encounter.
Consider the possible liability of the public administrator and how he or she should proceed.
