Throughout this class you will learn about disparate treatment discrimination (intentional discrimination) and disparate impact discrimination (unintentional discrimination). Disparate impact is a policy that seems neutral but has a disproportionate impact on members of a particular group. For this discussion board select a particular protected class and tell me about a policy that you believe would have a disparate impact.

So, you might say a company has a policy that because it sells clothing to young people, it will not hire people with gray hair. The protected class is age and this is a disparate impact because this policy will eliminate more older people than younger people. This would be your initial post.

For your response, you should comment on the policies of your classmates and answer two questions. 1. whether you think the employer should have a right to impose that policy personally and 2. What you think the law would say about the policy. Your response might be you do not think the gray hair policy should be allowed because when you buy clothing for a young person you think it make sense to have a salesperson who wears the clothing.

For the second part, you might right that you know that this policy would not be allowed under the law because it discriminates against older people and there is nothing about gray hair that means a person cannot sell clothing. Also, you might say that in some cases an older person might have children and therefore know a lot about the clothes worn by a young person which would actually make them a better candidate.
