Question: The United Brotherhood of Carpenters has a dispute with Brady Contracting over Brady's use of nonunion employees on construction jobs. The union claims that Brady's wages and benefits are below the area standards paid by unionized contractors. Brady is currently constructing several retail stores in the Phoenix area. The union sent letters to the various retail store owners, urging them not to work with Brady until Brady agreed to pay area standard wages and benefits.

The union also informed the retailers that the union would begin an "aggressive public information campaign" against Brady, including displaying banners at the retail stores. The union then set up protests at several retail stores-it displayed large banners reading "Shame on [the name of the retailer]" and "Labor Dispute." The banners were displayed on public property about twenty feet from the retail store. Union members also distributed handbills that explained that the union's dispute was with Brady and not the retailer. Brady and two retailers filed unfair labor practice charges with the NLRB.
