Zane and Zoe are zookeepers at the Sunbury Open Range zoo near Melbourne. They had previously been in a volatile personal relationship, which had ended a month earlier. One morning while cleaning inside the shark enclosure, they had a heated argument about who was going to work over the Christmas to New Year period. Zoe demanded Christmas Day off. In a subsequent interview which Zoe gave to the police, she stated that Zane had started swearing at her while they both moved towards a corner between the fence and the pool. Zoe admits that she pointed her finger at Zane and grabbed his shoulder in an attempt to calm him down. To her astonishment Zane jumped into the water. His blood quickly attracted one of the sharks causing a frenzied attack. Zoe managed to grab Zane's outstretched arm and with her help, Zane was able to pull himself out of the shark pool, despite having lost a leg. Zoe rendered first aid as best she could and immediately called an ambulance. Upon arriving at hospital, the treating doctor advised Zane that he needed to give his consent to a blood transfusion or he would die. Zane refused to provide his consent citing his religious beliefs. Zane died soon afterwards. Required: Advise the Director of Public Prosecutions as to Jill's criminal liability for murder.
