Case Facts:
On 12 September, at 2:00pm, Mason Malfoy (he, 20 years old) and Greg Goyle (he, 21 years old) were walking down St Kilda Road. At the same time Senior Constable Flavio Harry (he) and Constable Roland Matthew (he) were together on duty.
Constable Matthew and Senior Constable Harry were approached by Bobby Boat (he). Bobby works in a nearby coffee shop as barista. Bobby informed the two police officers that two persons had left the coffee shop without paying for their coffees and the sandwiches they had consumed. While Bobby was talking to the police officers, Mason and Greg passed by. Bobby saw Mason and Greg and pointed at them, saying, "These are the two I was just talking about."
Constable Matthew and Senior Constable Harry immediately followed Mason and Greg and told them to stop. Mason and Greg complied. Constable Matthew said to Mason and Greg, "We've heard the two of you didn't pay for food and drinks." Then, the two police officers requested Mason and Greg to state their name and address, which both of them refused to provide. Mason shouted, "I don't know what you want from us. Go away. Mind your own business. We don't need to tell you anything. You are harassing two innocent people." Senior Constable Harry replied that consuming food and drinks in a restaurant without paying is an offence contrary to s 81 of the Crimes Act 1958 (Vic).
