Construction Contract Administration

Develop the following graduate attributes, construction management knowledge and professional skills linked to this unit.

Learning Outcome 1: Critically analyse and reflect using cognitive and creative skills on legal concepts and their application for the construction industry (ULO 1).

Learning Outcome 2: Identify optimum contractual solutions using Australian Standards general conditions of contract (ULO 2).

Learning Outcome 3: Evaluate and interpret commonly used contract price and project delivery options to enable the procurement of complex construction projects (ULO 3).

Learning Outcome 4: Formulate and apply available remedies to construction contract disputes (ULO 4).

Learning Outcome 5: Evaluate and interpret the complexity of issues associated with identifying and selecting the different types of insurances used for construction projects (ULO 5).

Question 1. Development of a project specific framework for on-site contract administration (2 pages)

Critically analyse the historical causes that led to the establishment of the Security of Payments (SoP) ACT. Select three (3) specific sections in the SoP ACT of your State and discuss how these sections and related clauses are used in legal and industry processes to manage those historical issues

To have the rights of adjudication (including providing an adjudication response) evaluate the requirements under the SoP ACT of your State for preparing a ‘Payment Claim' and for preparing a ‘Payment Schedule'. Include in your response the key aspects to be included and relevant time limits set out by the legislation.

Question 2. Preparation for alternative dispute resolution (1 page)
Your construction business has been served a formal notice of dispute from a sub-contractor seeking arbitration under AS 4901(1998) - Subcontract conditions. Formulate how you would prepare for the arbitration process and effectively manage potential advantages and disadvantages for your business following the provisions of AS 4901 (1998) and the Arbitration ACT of your State.

Question 3. Reflection on complex issue management and relevant skills for a contract administrator (1 page)
Practical Completion (PC) can be complex and time consuming due the involvement of multiple tasks associated with diverse assessment needs (i.e., physical asset, handover information and test results) and procedures. Your task here: Evaluate the responsibilities and processes during PC as set out in AS4000 General Conditions of Contract from a Contract Administrator's perspective. Write a personal reflective statement on how you would support your business as Contract Administrator to reach and complete PC effectively and efficiently.
