Ethical Circumstance

A paralegal is conducting research for a case that is being considered in court the following day. Toward the end of the day, the paralegal receives a routine e-mail update from the highest appellate court of the state. The update indicates that a decision that day by the high court would severely and negatively impact the case, which until now was quite strong. The paralegal informs the attorney. The attorney is faced with the ethical decision of whether to bring up the recent change in the law at the hearing, and almost certainly lose the case; or take the chance the the judge and opposition are unaware of it, and win the case for the client.
