As decided by Clean, it is vital to hire George Tacy as an agent responsible for the recruitment and hiring of computer and IT employees, as needed. Before Clean can develop a thorough and definite agency agreement, they must determine the type of agreement they wish to establish with Mr. Tacy. Clean has the choice to either hire Mr. Tacy as an employee or an independent contractor to fulfill the necessary onboarding of IT and computer employees.
An independent contractor is one who is contracted to work or serve on behalf of another entity and is not controlled or compensated by the entity (Saylor, n.d., para. 14). Independent contractors typically fulfill job duties in a short time period and are not contracted for a long amount of time, which differentiates from an employee. Opposite of independent contractors, employees are compensated, supervised, and scheduled by the principal who hires them. Additionally, employees are hired by organizations to fulfill long term roles and positions. Independent contractors are contracted when needs arise for the area of work they are skilled in. The need for hiring of a new IT and computer team is an as needed job to be completed when vacancy arises and is not a full-time position for Mr. Tacy. As an independent contractor Tacy would have more control and less supervision over his work completed for Clean since he is specialized in the line of work, which Clean does not have much knowledge on.
It is recommended that Clean hires George Tacy as an independent contractor responsible for the recruitment and hiring of an IT team. Clean will need to ensure that the agency agreement between the two is clear and definitive on the terms of the relationship to prevent breach of contract. The agreement agency will include timeline of agreement, specific needs and requirements and once fulfilled the contract is terminated.
