Bert owns a small five-person consulting firm. He wants to terminate one of the consultants, George, for performance-related problems. George, who is 38 years of age, has been with the firm six and a half years and the quality of his work is excellent. Further, he's a really nice guy. The problem is that he is a perfectionist and is extremely slow getting anything done. He keeps missing crucial client deadlines, and clients are starting to take their business elsewhere. It has reached the point where none of the other consultants are willing to work with him. Bert has spoken to George about this many times over the years (and this problem has been noted in all his performance reviews) but there has been no improvement. George is just incapable of picking up the pace. Bert wants to know whether he has just cause under the common law to dismiss George. Discuss.
