Assignment:

Serena, to celebrate her 21st birthday, organizes a birthday night with a group of friends. The group includes 4 people of the same age and two friends who have just turned 17: Jonathan and Carla. During the first part of the evening, at dinner in a trendy restaurant of Niagara Falls, they party shares 2 bottles of wine. Everybody drinks, to celebrate Serena's birthday. During the second part of the night the party moves to a dance club where more alcohol is consumed. At the end of the night, while going home with his bike Jonathan loses his balance and falls on the sidewalk, hitting his head. He is taken to the hospital with a serious head injury and the blood work unveils his altered state of drunkenness.

Based on the information presented above and applying the legal concept studied in the past weeks, provide a motivated response to each of the following questions:

1 - Determine if there are elements of legal liability that can be found in this case define the related legal principles.

2-  If you found elements of liability, identify the subject (or subjects) that should be held accountable for the unfortunate event.
