Case Study: According to the official offense report on 11/29/2009, Officers responded to a Robbery call at the liquors store liquors store located at 11411 Bandra Rd suite 102, SA, TX . The complainant (Manager) reported the defendant came into the location and grabbed a Patron Tequila Gift Set, priced at $159.99 and asked the manager for the price. After the complaint informed the defendant of the price, the defendant told him "see you later dude" and ran out the store. The defendant jumped into the passenger side of a dark blue, ford f 150 truck. The complainant chased the vehicle and jumped into the bed of the truck as it tried to flee the scene. The driver of the truck was driving erratically to shake the complaint off of the truck. The driver of the truck stopped the truck and the defendant exited the truck with a baseball bat. The dependent swung and hit the complainant with baseball bat and then got back into the truck and drove off. EMS was called to the scene. The complainant was treated at the scene and refused to be transported by a photo lineup as the person who robbed the City Liquor store. The defendant was arrested and charged with Robbery on 6/12/2009 for Instant Offense.
The defendant stated "he doesn't agree" . If he was hurt as bad he would habe went to the hospital but they guy refused treatment or to be transported to hospital. I didn't hit him with the bat. I swung the bat, you know like telling him to get out, but I never once touched him with it. I went to grab tequila bottles that was my only intention. It was stupid. I was just going to run in a get some tequila bottles and run out. I did not want to have this happen.
Questions:
1) Do you recommend this individual to be placed on community supervision why or why not?
2) For each case write court programs and recommendations for these offenders. Provide an explanation for each recommendation. On the last page of the PSI - you will see suggestions for court programs, classes, sanctions etc. you can use these programs provided or add additional programs you feel will benefit these offenders.
3) Determine Restitution Amount and provide explanation for the proposed amount.
4) Determine CSR hours to be worked and recommend where these offenders should complete the CSR hours. Provide explanation for the proposed amount and CSR location.
