Joe is 24-years-old. He was born and raised in the Phoenix area. He has been riding in cars in Phoenix his entire life and has been driving since he was 18. One afternoon, in July, Joe visited the Cars-r-us car dealership in Phoenix to test drive a car. It was a typical hot, sunny day in Phoenix and the outside temperature was 110 degrees. Joe had no intention of buying a car but just wanted to see how the car drove. When Joe sat in the driver's seat of the car, his thighs were burned by the black vinyl of the seat. Joe sued the car dealership for negligently failing to warn him of the dangerously hot conditions of the car seat.
