Assessment Part A - Position Statement
Working in a team, you will present a position with regard to an assigned legal and ethical issue related to social work practice.
Details of task: This task requires you to form groups of 4 social workers, and research a position statement from a variety of angles. Students are required to analyse, evaluate and then present a clear and consistent argument by examining how international human rights, national legislative frameworks, social justice-focused practice approaches, and Australian social work ethics interact by contextualising them within the human rights discourse.
Position Statement: Your group will focus on the Victorian approach to child protection involving Aboriginal children as outlined on the Department of Health and Human Services' website. Analyse the degree to which the department's approach meets the requirements outlined in the UN convention on the Rights of the Child and the Declaration on the Rights of Indigenous people, how these principles have been translated into the Victorian legislation and into the currently model of practice. Your discussion should (a) contain relevant references to individual articles of these conventions/declarations/legislation, (b) clearly articulated outline gaps, and (c) make evidence-based suggestions as to how the approach could be improved.
Your presentation should (please note this is a guide only) contain the following:

2. Describe the rights of Indigenous children and family members
3. Describe the key issues of child protection involving Aboriginal children
4. Describe the legal and organisational mandate that governs the state's response to this situation
5. Outline how this mandate lines up with relevant UN charters and declarations

7. Outline promising alternative approaches that are evidence-based and culturally sound

Assessment Part B: Reflection
Drawing on their experience of the debate, each student will construct an individual critical reflection analysing their role as a social work practitioner with an ethico-legal context.
Details of task: Based on your experience of the group work underpinning Assignment 2 - Part A, write a critical reflection of implications of the contradictions inherent in Aboriginal child protection:

• for social workers.
