Joanne and her husband could not have children and decided to adopt. When their adopted baby daughter came into their care, Joanne applied for both pregnancy benefits and parental benefits (61 weeks) under the federal government's employment insurance program. She was given parental benefits but denied pregnancy benefits on the basis that she was never pregnant. Joanne challenged this denial based on the equality rights provision in the Charter.
