It is difficult to define fire department liability and immunity because emergency responders, their districts and departments have immunity that is intermingled and involves statutes and statutory provisions by the government. According to DiCianni (2007) under the Tort Immunity Act in Illinois there is no liability of the fire department for operating motor vehicles, or firefighting or rescue equipment when answering an emergency call, except for willful and wanton conduct. This is upheld even if the responders were responding to a false call/ alarm or transporting of an individual to a medical facility. After the call is answered, immunity does not apply. Although the fire department is not liable while going to the fire, it could be liable upon return from the firs (DiCianni, 2007). There is a very thin, distinct line between fire department liability and immunity.
