Actus Rea and Mens Rea
Scenario One
This scenario has a clear actus reus and a mens rea. In this scenario, the actus reus gets up on a moving bus and falls on another person. The law states that as the bus moves, everybody must be seated and fasten their seatbelt. Mens reain this scenario is when the individual fell on someone theydidn't like: they committed battery. They achieved this crime by waking up when the bus was still moving. An assaultincludes intentional touching without consent, actual battery against another person, or injury caused by contact with another person, which was committed in this case.
Scenario Two
This scenario provides the legal definition of actus rea. Actus rea means "guilty mind." In this case, the subject acted wilfully and intentionally: tripping someone does not excuse him from responsibility. He would also need to have been aware that his behavior would cause injury or death. On the other hand, mens rea is shown when, in the scenario, the defendant broke the law when he acted with malicious aforethought, namely in causing the 50-year-old man's injury while acting with wanton and willful disregard for a high probability of causing death or great bodily harm. An assault is an intentional threat or the act of physical force against another person who is not a reasonable response to any immediate danger committed in this case.
Scenario Three
The actus rea, in this case, is based on the fact that the individual is furious, approaches the others, and thinks about punching them in the face. On the other hand, mens rea is shown when the individual acts with malice towards both parties, as he intended to inflict pain. This was enough to constitute a charge of assault and battery. The critical point in this scenario is that the individual was angry and about to attack. An assault is one type of battery, a crime that was not committed in this case.
