Plaintiff buys a car with a defective seat belt from Defendant. Plaintiff brings the car back to Defendant claiming the seatbelt is defective and requests a new belt, Defendant agrees however a new seatbelt must be ordered and that nothing can be done until a new one is received from the factory. While waiting for the new belt, Plaintiff knowingly drives the vehicle without wearing a seatbelt and is involved in an accident. Plaintiff is injured and sues defendant for his injuries that an expert states could have been prevented had Plaintiff worn a seatbelt. Your firm represents Defendant.
