Question

Police officers mistakenly entered the apartment of the deceased mother in-law in a narcotics raid. Realizing their mistake the officers raided the apartment directly above. While lowering his Ar15 rifle to the floor, one officer accidently discharged a bullet, which blasted through the floor grazing the head of a 2 year old baby and killing the father in the apartment below. what civil liabily issues are invloved and what would the likely defense be?
