Patty has decided to bring a lawsuit against Dave's Paintball Emporium for negligently providing the players with paintball pellets that were capable of causing such devastating injury.

You are a paralegal at the law firm representing Dave's. Ms. Jones, a partner at the firm, has asked you to research defenses to negligence and provide a memorandum. She asks that you:
