Question

A murder is committed with a crossbow in a small retirement community. Officer Tanaka questions the victim's neighbors. One of the neighbors tells the officer, "Jimmy owns a crossbow." In a later trial of Jimmy for the murder, Officer Tanaka seeks to testify about what the neighbor told him. The defendant objects that it is hearsay. The prosecution responds, "The neighbor's statement is not being offered to prove that Jimmy had a crossbow. We are offering it as evidence that Jimmy killed the victim."
