Criminal Evidence and Procedure

Incrimination by Silence Paper

A confession is generally viewed as the same as a guilty plea in open court. An incriminating statement differs from a confession in that a confession directly acknowledges guilt, whereas an incriminating statement "is any statement or conduct from which guilt of the crime can be inferred". With that noted, are there situations that you can think of where a person's silence would incline most people to think of it as being incriminating? Please explain three separate situations in which silence could be interpreted to mean the person is hiding something and explain each situation.
