(1) Criminal courts in most jurisdictions are very busy. (2) The large number of people arrested and prosecuted, the limited availability of defense attorneys to help an accused person prepare and offer a defense, and the overcrowded courts create a heavy caseload demand on everyone associated with criminal justice -prosecutors, public and private defenders, and judges. (3) The result of the crowded court calendars, court delays, and clogged caseloads is that most cases do not go to trial at all. (4) Most are "settled" through guilty pleas, pleas arranged among the prosecutor, defense attorney, the accused, and the judge. (5) Guilty pleas are induced through negotiations whereby the defendant pleads guilty to reduced charges in exchange for a lenient sentence, that is, a lighter sentence than the judge would normally give after conviction at trial. (6) This entire process is generally known as plea-bargaining, or plea negotiation.
