The following individuals have been placed in removal proceedings and are scheduled to appear for their first Master Calendar Hearing in the coming months. They have come to your office for an initial consultation regarding the consequences of their criminal cases on their immigration status. Based upon the information provided to you, please determine whether these non-citizens are inadmissible, deportable, or neither. Why or why not? If you need more information from the prospective client, please state what if any additional information or documentation you would need to make a determination.  

  • Vladimir is presently 30 years old. He has been a lawful permanent resident since the age of 12. At the age of 15, Vladimir was convicted of robbery in juvenile court. Ten years later, Vladimir gets convicted of robbery yet again. Vladimir's criminal lawyers have appealed his conviction. The appeal is currently pending.
  • Lloyd, a native and citizen of England is married to Mary, a United States citizen who has filed an immigrant petition for him. The I-130 petition has been approved. However, after the couple attended Lloyd's green card interview his adjustment of the status case was denied and he was placed in removal proceedings. The adjudicating officer cited Lloyd's 2000 conviction for passing bad checks as the reason for the denial of his case. Lloyd spent 1 night in prison in connection with this case. This is Lloyd's only criminal conviction.
  • Marie is a lawful permanent resident since 1990. Since that time she has been arrested and convicted three times. Each conviction has been for simple possession of marijuana.
  • Olivier is a native and citizen of France. He is 20 years old. His US citizen mother Louise is sponsoring him for a green card. Last year, Olivier was convicted of possession of a firearm. This is his only conviction.
  • Sue has been a lawful permanent resident for just over ten years. As a minor, she had been in juvenile court in connection with a drug case. Three years ago she was arrested and charged with possession of marijuana with intent to sell. She pled guilty to simple possession of marijuana.
