Look at page 201 of our book. The case Gideon v. Wainwright. Here Gideon a 3 time loser, was arrested for a small time burglary. Under 3 strikes he was facing a life sentence. He asked for a lawyer to be appointed by the state and was denied that request by the Court. He appealed to the U.S. Supreme Court under a "Pauper's Petition." He wrote hie petition on paper towels as he could not afford stationary.

It was a watershed moment and created the entire Public Defender system. What was the reasoning the Court used to force the State to provide a lawyer for all felony defendants who could not afford one? Should the State be responsible for providing free legal advice to those who cannot afford to hire an attorney? Later Courts adopted the "critical stages" test as to when you are entitled to legal counsel, should there be limitations on when you get free legal counsel.
