"To secure conviction for rape under the Sexual Offences Act 2003, the Crown must prove that a defendant lacked a reasonable, rather than honest, belief in the complainant's consent. This is unacceptable. The rule is a violation of the principle of orthodox subjectivism at the very core of criminal law theory and should be abandoned for that reason."
