James is locked in a public toilet due to the carelessness on the part of the cleaner, who locks the toilet door without checking to see if the toilet is occupied. James is then injured when he tries to climb out over the partition wall between his compartment and the one next door. This is because when James tries to climb up he puts his foot on a toilet roll holder, which revolves under his weight, causing him to slip and injure himself. Advise whether contributory negligence defence can be claimed.
