SIMON bought a railway ticket with the words printed on the front: 'For conditions see back.' The conditions were intended to protect the railway from claims for damages for negligence. While during her journey,SIMON fell into an unmarked hole , injuring herself. No notice or warning was placed near the obstruction. Can SIMON sue the railway for negligence and were the terms of the railway's offer sufficiently communicated to SIMON, and is this contract governed by the Australian Consumer Law?
