Jim Sailor, a 43 year-old minority, had been an employee of a large retail chain for 5 years. He was an outstanding employee, completing his work consistently as assigned. One night after completing his shift, Jim walked past the customer service desk and said "good-bye" to the employees working there. He was all bundled up in his warm outerwear as it had been sleeting and inclement weather was expected that evening. On his way out of the building he thought about how long of a walk it was going to be to the designated employee parking section. Employees had to park in the very back section of the parking lot to allow customers easy access to optimize their shopping experience. As he had almost reached the employee parking lot, Jim slipped on some ice on the parking lot. He laid there injured and he felt a lot of pain in his legs and could not get up. He laid there approximately 10 minutes, until he was discovered by a co-worker who helped him back into the store. They were immediately greeted by the store manager who indicated that the company would take care of the injury "just go to any hospital." After being treated and released for a broken ankle, Jim returned to work. At this time the manager indicated that the company would not be responsible for the medical expenses for the injury and that he would be demoted to a cashier because with his injury he could not perform his duties as stockman. Jim was very distraught because he knew what the store manager he previously said and he had trusted him.

Was this situation handled appropriately by Jim? The Manager? Why or Why not? Discuss the legal implications.

How would you have handled the situation?

Would you do anything to prevent this type of injury or confusion relative to treatment of injuries in the future?
