James, an international student, will be studying LAW960 next year as a compulsory subject of his MPA degree program at the University of Wollongong. He has been looking for a current edition used textbook since September 2022. He suddenly finds one on the noticeboard of the UOW Business School. Beauty had advertised the prescribed textbook for $120 on the noticeboard. James telephones Beauty and offers to purchase the textbook for $100. Beauty rejects the offer, so James decides to try elsewhere to purchase the book. However, he has no luck, so the next day he telephones Beauty again and offers to buy the textbook for $120. Beauty replies that she has already sold the book to another student. James replies that he accepted her offer of sale yesterday and that she (Beauty) had no right to sell the book to another student.
Advise James whether he can enforce his claim against Beauty. Your advice must be substantiated based on the common law rules regarding 'agreement', with clear reference to relevant cases.
