In response to increasing amounts of litter being left in the environment, the Western Australian Government passed the Environmental Protection Anti-litter Act 2022 (WA) [a fictitious Act], section 19 of which provides:
Any person who damages the environment by throwing, depositing or discarding litter in, into or from any place to which a member of the public has access commits an offence.
Perth city based tax accountant Leigh, was riding his bike home from work in early August 2022 on a particularly blustery and rainy day. In his backpack he had some client tax return papers that he was bring home to work on. Unbeknown to him, the backpack began to develop a split in the fabric. Sometime later while Leigh was riding alongside the river on the bike path, he was stopped and charged with a breach of section 19 by a Western Australian Police officer Scottie, who had noticed the papers flying out of his backpack behind him.
