1. Jackie is sick and tired of the neighborhood kids jumping over her yard well as a short cut to getting to school. Each time they do so they damage her plants, pots, flowers,etc. So, she decides that she will set up a booby trap in her own backyard to stop the trespassers. She has and old bear trap that her great, great grandfather used in the civil war to stop the enemies from cutting through the old Bunker Hill zone. It worked every time for him during the civil war and she figures it should work this time too. She sets up the old rusty trap and low and behold it actually catches one of those recally high schoolers. The trap did not dismember the kid's leg but seriouly lacerated it and caused some rust poisoning, all which required stitches and some hospitalization. Was Jackie entitle to do that?
A. Sure, because the use of force to protect her property and it was not deadly.
B. Sure, because the use of force was desined not to kill, but to stop the damage to her property
C. Sure, because a homowner is entitle to use force(although not deadly) to protect their property.
D. No, because home owners cannot use such force like she did not to protect their property
E. yes, and she could even be entitle to use even more deadly type force.
F. Jackie could have even used a gun to shoot the kids if she wanted to.
2. Todd is walking down a dark alley at night to his apartment after buying some diapers for his little baby. Todd is a 9th drgree Dan Rank red belt martial artist (i.e. He's dangerous). In the alley he sees an 85 year-old unarmed crippled grandma in a wheelchair mugging a 14 year-old boy for his backpack. Todd protects the boy by pouncing on small grandma with his specialty round house kick causing her to fall over onto the ground, immediately neutralizing her, and then he knocks her out with a further blow to the head Grandma livesthrough the incident and is OK now. Can grandma sue Todd in civil court for battery?
A. No, because she was attacking the boy and Todd was only using reasonable force to protect him.
B. No, but she can sue him for fasle imprisonment
C. Yes, because the force was excessive and deadly
D. No, because she assumed that such an attack could happen bu mugging an innocent child.
E. No, because Grandma deserved her "beat down" for her actions.
3. Thomas( Known as "The Dog") owns a local store that he calls "Doogie's Liquor". Thomas loves dogs. Actually his small poodle is present at all times with him each day while business is open. His dog, named Tomtom., sits on the cash register counter each morning of business and Thomas believes that if Tomtom barks at a customer cannot be trust and is a potential thief. Once day, 80 year-old Mable strolls into the store in her wheelchair to buy some liquor when Tomtom, uprovoked, jumps in her lap and barks at her. Thomas thought that she was thief and instucted Tomtom to bit her which he did. Can Mable sue Thomas for any tort?
A. No,because Thomas did not strike her in any way.
B. Yes, for battery because he instructed the dog to bite her.
C. No, because she entered the liquor store with the intention to commit a felony.

4. Zippy works for home depot as a loss prevention specialist. His job is to stop all thefts in progress in the store. He hides in those boxes you see in the upper shelves above the merchandise in the store. Zippy kind of thinks he is like Batman in a way because he envisions himself jumping from the upper shelves, zipping down to the ground to stop thefts in process, Once day, Maurice enters Home Depot. While there, Maurice decided to pocket some tool in the pool department. Zippy sees the theft snd explodes through the upper box he was hiding in, captures the thief, ties him up and drags him by the legs 100 feet to the security room in the back of the store. Zippy called the police a couple of hours later, but kept the the thief in the back room without allowing him to use the restroom and with no water. The police showed up and thanked hime for stopping the thef in process. Does the thief have any civil rights in court to sue for any torts here?
A. Yes, there may be a tort for fasle imprisonment because the detainment appears unreasonable, and possibly for battery for dragging him through the store.

Lupe has been a verbally abusive husband for the entirety of the marriage. gabby has never worked and was a homemaker, housewifem and mother of Lupe's three children for the marriage while Lupe worked, paid the bills and supported the family Lupe would never give Gabby any money to pay bills or buy anything. Gabby has no work skills and no education. Gabby never left the married because she was afraid to leave due to fear of being homless and penniless. Also, she never leaved because Lupe always said to her," If you ever leave me, I will kill you." Lupe never struck her or physically abused her. Gabby, now 60 years old, is tired of the verbal abuse and now has the strength to leave. Can Gabby sue Lupe for fasle imprisonment?
A. No, because she stayed with Lupe for the entirety of the marriage and never left during the alleged abuse.
