Caleb is walking down the street when, suddenly, a bicyclist crashes into him. Emily, the bicyclist, did not see Caleb in time to stop because she was busy texting on her phone. Caleb suffers severe injuries from the crash and is hospitalized for three days. Both Caleb and Emily live in Kentucky. Caleb learns that under Kentucky law, KRS §544, it is illegal to text while riding a bicycle. The Kentucky state legislature enacted the law in response to receiving numerous complaints about “texting while bicycling” injuries. When Caleb is released from the hospital, he files a lawsuit against Emily for his medical expenses. Caleb is seeking $10,000 in damages.
