Question - Mark and James are involved in an accident in downtown London. According to the Ontario Fault Determination Rules Mark was 25% at fault and James was 75% at fault. They were both merging into traffic. Damage to the front passenger side of Mark's vehicle was estimated at $4,500. Damage to the driver's side of James' car was $3,600. Mark rented a vehicle while he was in for repairs at a cost of $240.00. James decided to take a taxi to work and submitted bills in the amount of $36.00.
Both drivers had $1,000,000 of third-party liability coverage, with a zero deductible on the DCPD portion of their policy. Mark also carried collision with a $500 deductible and had purchased the Loss of Use endorsement. James did not have collision coverage or loss of use on his older vehicle.
