If selling a house and the Buyers provision is for a marketable title:

Accept such title as Seller is able to convey without reduction of the Purchase Price, or"cancel this Agreement and receive a return of all Deposits. The house did not have a marketable. Seller decide the deal is off and offer to return deposit. Buyer refuse and exercise their options filing a lawsuit. Did the seller breach the contract and if so what would be the appropriate remedy.
