Bob goes to the “Busted-Down Used Car Dealership” in Natchitoches, La. and wants to buy a used car. Dandy Dan, the salesman, talks Bob into buying a 2005 Honda Civic that has 45,000 miles on it and the purchase price is $2,500. Before agreeing to the sale Bob asked Dan if the car had ever been in a wreck and Dan says “…….not to his knowledge” so Bob buys the car. Three weeks later the transmission on the car falls apart, then 2 months later two of the tires fall off when the car was parked and over the first 11 months Bob had the car he had to take it back to the dealer 9 times - 4 times for the transmission – and the car was out of service to him for 92 days. Bob finally brings the car back to Dan 11.5 months after he bought it and tells Dan he has found out that the car had been I a wreck in another State he wants all of his money back. Dan refuses and says under the law he still has the right to try to fix the car. Bob sues Dan for the return of his purchase price and you are the Judge. What are the rights of all of the parties and give reasons for your answers.
