Easement Assignment:

Below are three parcels of real property A, B and C. B wants to have a built-in swimming pool installed in his backyard. In order to run the water line directly from the main in the street to the site, the line must run over his neighbor’s property. Neighbor C has consented in theory to the easement and has asked Neighbor B to have the easement drafted for his review and consideration. The diagram below shows the properties and the black line is where the waterline is projected to be buried underground. Neighbor B comes to the law firm for whom you work and the attorney asks you to draft the easement in layman’s terms. Assume you have the surveyor’s legal description for the two parcels of property and for the property that will be subject to the easement. The attorney also asks you to make a list of any additional information needed from our client to complete the task. Please submit a proposed easement for Neighbor B. Please do not try and make it sound like a legal document; you do not need to do any legal research for this assignment, but please do take the time to consider what should be included to create the easement and best protect and provide for your client’s interests.
