The Army Corps of Engineers has a contract with Construction Ltd. to build a number of buildings on Government property. Shortly after starting excavation for the second building, the contractor uncovers buried toxic waste. The contractor and the Government cannot agree who is responsible for the cost of cleaning up the site. The Contracting Officer directs the contractor to do the cleanup. Construction Ltd. submits a claim which is denied. Construction Ltd, can file a law suit against the Government.
