John Buyco is a Candian importer. He is on a buying trip for electronics in HongKong. He buys five containers of goods. Each container has a different product purchased from different manufacturers. He buys the following:

a. one container of television sets;

b. one container of VCRs;

c. one container of toasters;

d. one container of computer monitors ; and

e. one container of pocket calculators.

1. Buyco discovers that 5 of the 200 television sets he purchased are slightly scratched and will have to be touched up and sold at a discount. He is a perfectionist and tells the seller:" This is unacceptable. It is a breach of contract. I want to return the entire container and get my money back". What kind of breach is it? How can you tell? Will it let him out of the contract? If not, what remedy is available to him at law? Explain your answer.
