Harak Co made toys for children. One of their toys was a ball with a hard surface, which was designed to be bounced on the ground and to make a loud noise. Joan, a child, and her friends were playing with the toy. One of the friends, Kelly, bounced it on the ground. It struck Kelly in the eye, causing her to lose sight in her left eye. She sued the toy company on the ground that it had made a dangerous instrumentality and was therefore liable for the resulting harm. Was it liable? If so, why?
