Sixteen year old Alice is a high school junior who looks at least 21 years old. She sees a parcel of land that she would like to buy in order to build a house after she graduates from college. Alice contacts Loren, the owner of the property, about buying it for $15,000. He asks her how old she is and she replies "I'm 21." He then draws up a sales contract for the land. Alice pays $1,000 down and signs the sales agreement which states that she will pay $500 a month until the rest of the entire purchase price is paid. Alice makes 5 payments of $500 to Loren. On the sixth month, just before her 17th birthday, Alice goes to Loren and says she is tired making payments and wants her money back. Is Alice entitled to the return of her money and avoidance of the contract? 

 

Bob's brother Steve planned to visit over the Labor Day weekend. The two brothers planned to build a deck in Bob's back yard that weekend. Bob ordered the lumber, concrete, nails, and other supplies to be delivered on Friday of that weekend. He also contracted to rent a saw for that weekend (Saturday, Sunday and Monday) at a cost of $20 a day. When he went to pick up the saw, the store had rented it to someone else. He drove all over town trying to rent another saw, but he could only get one for Sunday, Monday and Tuesday at a cost of $50 per day. Because they couldn't work on Saturday without a saw, Bob had to hire Mac to work with him on Tuesday. Of course, Bob had to take Tuesday off from work. Calculate the damages that Bob is entitled to from the rental company. Explain. 


After school has been in session for 2 months, the Business Administration Building is destroyed by fire. The University refuses to pay Professor Glass any further salary, claiming that it is discharged from its obligation to perform the employment contract because of the fire.
